If there is still plenty of time left on  a auction you can kick bids. If you don't like the bid amount or what the seller is doing then just find  a different seller. There are other reliable sellers on there like Toshi at Dream Stars and Hit Japan.

As for sending Gearbolt back to the seller, not to be mean, but if the guy was acting shady and ripping you off then proof of shipping back should have just come as instinct since it was likely the seller would claim it would have not arrived otherwise. Ebay is in the right on that,as you couldn't prove you shipped the item back. I guess everyone has to have their first bad experience though so they can learn how to prevent it from happening in the future.

I am actually a large customer of Hit Japan, and I have ordered from Dream Stars too, but Dream Stars costs a lot more money that Hit Japan so I usually only try to get rare accessories from them.  Although my tranactions with Hit Japan have not been without some frustrations, like ordering a game and only getting 1 of the CDs, then having to argue with them for nearly a week that it is actually a 2 disc game.  Still they have been willing to negociate prices and shipping with me and that's a big plus in my book

Anyways, I told ebay flat out that I didn't want to mail back the game to the seller because I didn't trust them and ebay told me if I didn't mail it out right away that they would not let me get a refund.  I was totally ignorant at this point in my life that ebay would screw me as well as a scammer/seller would.  All ebay did was admit to me they didn't know why the worker didn't tell me to do that (since she never told me to in the logs) and that the next time this happens I should register the mail. ](*,)

I had already had to pay the origional shipping, the shipping to get the photocopied manual, and they expected me to pay to ship it back to the seller (I would not get any of this money back).  I shipped it as cheaply as I could.  According to US law anyways I should not have to mail anything back for a refund because any item under 500 dollars of value which is mailed to you, which you did not order, you may keep (because it's legally yours).  Since I did not order a loose, poor condition disc of elemental gearbolt nor an illegally photocopied manual they would belong to me and the person who sold me the game would still have to send me what I ordered.  However how often do you think people will take people to court for matters around 30 dollars?  Ebay should have been able to tell this is a scam type of practice.  After this happened I didn't use their service for over a year or two.

I wish you the best of luck with this auction, but it ain't looking good.  If you overlay the auction photo for the auction that Tatsujin posted, you'll see that the stack of games is identical to the pile of games in your auction (minus the loose HuCards).  Good luck, you'll need it.

Then ebay told me I should have registered the package and because I didn't, I wouldn't get a refund.  So I ended up with an image of the game on my HD and nothing else.  I am really upset at ebay for it since they didn't tell me to register the package until after it had been over a week since I was told to send it (and already had mailed it).

Sounds like you learned the hard way that Ebay (and PayPal) require that everything be shipped with delivery confirmation.  Few sellers ever send me my stuff registered or confirmed; they're lucky that I'm not a douche (well..... I am a douche, but not a lying douche), or I could claim that they didn't ship and they'd be shit out o' luck.

Update- The seller contacted me and gave me a tracking # about a week ago and told me that it would come in two packages.  The first would have the Super CD-ROM(and hookups), multitap, and all of the games with cases.  The second would have the rest.  I got the 1st package today and everything looks OK so far.  The unit has some scuffs and was a little dirty, but I'm ok with that.  The only thing that kind of sucks is dude didn't pack super nice so a small piece if the unit broke off.  I'll get some pictures up later today-

Well I used some oxy clean and the system cleaned up pretty nice- still a few scuffs and a little fading, but nothing too bad-

I super glued the broken piece back on, but you can still see the crack upon close inspection- now I'm just waiting for the coregrafx II so I can fire it up-

Congratulations. Frankly I'm amazed you got anything out of that transaction (it just looks too good to be true , and then D-Lite's findings of the same picture on another auction site = RED FLAG).   I hope to god that second box actually comes.   You may consider opening a Paypal dispute before it's too late.

I also found it a little suspicious that the seller, when asked if the CD player worked, was like "I'll tell you next month!"  knowing full well the Buy It Now would be snapped up fast.

hey, that's how it goes.    After 15 or so years of buying / selling online I've been burned more than once.  Everybody makes mistakes - especially at first.  The golden rule applies here, too :  patience.

OMMMMMMMM OMMMMMM OMMMMM

Yeah- I still have some concerns, but I've got another 2 weeks to file a dispute, so I'm giving the seller the benefit of the doubt.  I've been doing online transactions for about 5 years and have yet to be burned as a buyer.  This is probably the most unestablished seller I've ever dealt with, but the risk to value on this was too good to pass on.  He sent 36 games with the super cd-rom, and has been real apologetic about the delay, so I'm hoping that the second shipment will be along soon.  If it does come I'll give the seller positive feedback even though it took forever to get.  $180 shipped is a hell of a deal...

You obviously never bought from Bullseye Video Game Collectibles.

36 games?!? Man you got a sweet deal. Don't even stop patting yourself on the back for this one. Are they good games?

Most of it's filler, but there's a few good titles in there-

The real cool thing is that there should be another 15-20 games(loose HuCards) that come with the 2nd package- I'll let you know how that goes-

Sweet, there are some really good titles in there.

On the other hand, it's not too late to throw out that Momo game.

Awesome news on the stuff!  Very happy this all worked out for you.

The more I think about it, it sounds like the seller had buyer's remorse.  He bought it and then decided to sell right off, probably due to money or something as such, hence the buy it now and the auction before the seller probably even had the goods.

I was thinking that too since its taken so long to get the deal finished.

I'm almost sure that's what happened- the 2nd package just got delivered and it came from Japan rather than HK.  This package had a coregrafx II, 4 controllers, and 20 loose Hucards in it.  Now to test it all-
