M$ should have allowed that NES emulator on their X1 app store.

Even if Microsoft would have allowed it I am sure the Big N would have it forcibly removed

They could try, but there's nothing illegal about an emulator.

Exactly, an emulator by itself is not illegal. Don't advertise it, just let it be in the sea of apps. The Google play store for example has commercial NES emulators and the big N hasn't said anything.

I think it wasn't just Nintendo that MS didn't allow it.  They have plenty of partners that are trying to sell collections, or digital versions of their old 8 bit and 16 bit titles.  It probably wouldn't make them happy either.
